Privacy Policy

Preamble

WED, Inc. (hereinafter referred to as "WED" or “We”) has created Baaaa, an app allowing users to interact with the real world through the lens of their smartphones (hereinafter referred to as the “Services”). In order to do so, WED needs to process personal information about the users of the Services (hereinafter referred to as the “Users”, “Data Subjects” or “you”).
WED has established the following Privacy Policy to explain how WED uses the Personal Data gathered through the Services (hereinafter referred to as "Personal Data”).
WED collects Personal Data to the extent necessary for achieving its purpose and through lawful and proper manner. If WED obtains Personal Data via third parties, WED observes that the parties obtained such data through lawful and proper manner, and makes sure individuals' rights, interests and privacy are not to be harmed.
WED does not provide Personal Data to third parties without prior consent of the Users except in cases in which the provision of Personal Data is required by laws and regulations.
WED takes security measures in conformity with laws and regulations for the prevention of leakage, loss, damage, unauthorized access/usage/destruction/alteration, and so forth.

1. Acquisition of Personal Data and Purpose of Use

Sign up and Login
The Services require Users to sign up for an account before using them.
In order to use our Services, WED will link your Apple account to the Services. As such we will collect your email address on file with your Apple ID account or a private relayed email address if you use the Hide My Email option provided by Apple.
Users provide us with information including age and their username that they choose to use on our Services. WED collects and uses this information in order to authenticate Users when registering an account and use the Services, to make sure Users are eligible and able to receive the Services, and so that Users receive the correct version of the Services.

Inquiries and Purchase
Users also give WED Personal Data when making a purchase to WED, subscribe to WED’s publications, enter a survey or communicate with us. Depending on which Personal Data Users provide, that may include name, mailing address, phone number, country of residency, age, and email address.
WED use that information to fulfil those Services and to provide related customer support to you.

Location information
WED process Users’ device location information as they use our Services, to get meteorological information on Users location. The Services include location-based feature in order to provide a gameplay experience tied to your real-world location. Location information shall however not be saved on WED’s servers.

The processing of Personal Data is based on the consent of the Users.

2. Storage and deletion of Personal Data

Personal Data will be securely stored in Japan.
WED will retain the Personal Data for the period required to fulfill the Purpose of Use mentioned in 1. The specific retention period will be determined by considering the purpose for which the Personal Data is acquired and processed, the nature of the Personal Data, and the legal or business necessity for retaining the Personal Data.
Once this time period has expired, WED will promptly delete Personal Data from WED’s storage media.

3. Use Personal Data of Minors

WED acknowledges that the processing of Personal Data of minors requires special protection, as set forth in particular in the General Data Protection Regulation (GDPR). Therefore, WED shall ensure that:
Processing of Personal Data of minors shall only be carried out with the explicit consent of the minor or their legal representative, in accordance in particular with Article 8 of the GDPR;
WED shall take appropriate measures to verify that the consent of the minor or their legal representative has been given, taking into account available technology;
WED shall ensure that Personal Data of minors is not processed for purposes that are not appropriate for their age, interests, or any other relevant factor;
WED shall ensure that Personal Data of minors is not disclosed to third parties without the explicit consent of the minor or their legal representative, except as required by law;
WED shall provide minors with appropriate information regarding the processing of their Personal Data, in a clear and plain language, and shall take all necessary measures to ensure that minors understand the information provided;
WED shall ensure that minors have the right to access, rectify, or delete their Personal Data, and shall take all necessary measures to facilitate the exercise of these rights by minors or their legal representatives;
WED shall ensure that minors have the right to withdraw their consent at any time, without prejudice to the lawfulness of processing based on consent before its withdrawal;
WED shall ensure that appropriate technical and organizational measures are in place to safeguard the Personal Data of minors against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.
By using WED's services, you acknowledge that you have read and understood the above clause regarding the use of Personal Data of minors, and you agree to comply with all applicable laws and regulations related to the processing of Personal Data of minors.

4. Transfer of Data outside of the EEA

Japan
As WED is based in Japan, WED securely process Personal Data mainly in Japan. On January 23, 2019 the European Commission has adopted an adequacy decision on Japan, allowing Personal Data to flow freely between the two economies on the basis of strong protection guarantees.
Third countries
If applicable, WED shall put the appropriate legal framework in place, notably Standard Contract Clauses (SCC) approved by the European Commission.

6. Data Subjects’ protection rights

Data Subjects are entitled to the following data protection rights:
The right to access - Data Subjects have the right to request WED for copies of their Personal Data.
The right to rectification – Data Subjects have the right to request WED to correct any information Data they believe to be inaccurate. Data Subjects also have the right to request WED to complete the information they believe to be incomplete.
The right to erasure – Data Subjects have the right to request WED to erase their Personal Data, under certain conditions.
The right to restrict processing – Data Subjects have the right to request WED to restrict the processing of their Personal Data, under certain conditions.
The right to object to processing – Data Subjects have the right to object WED to process their Personal Data, under certain conditions. In particular, where Data Subjects have provided Personal Data voluntarily, or otherwise consented to its use, Data Subjects have the right to withdraw their consent.
The right to data portability – Data Subjects have the right to request WED to transfer the data that WED has collected to another organization, or directly to Data Subjects, under certain conditions.

7. Policy regarding use of Cookies

Some of WED's web pages use cookies and/or web beacons to provide better service to users of our website (hereinafter referred to as the “Users”). Cookies are text files placed on Users’ computer to collect standard internet log information and visitor behavior information.
WED keeps track of Users’ access logs information on its website, such as IP address. WED utilizes this information to monitor how its website is being viewed.
Except for the pages where user recognition is necessary, WED will not use the information to personally identify Users.
WED’s website uses Google Analytics, a statistic cookie, examining how Users use the website. Users can set their browser not to accept cookies. However, in a few cases, some of our website features may not function as a result.

8. Change in Policy

WED may revise the details of this Privacy Policy if necessary. Any changes made to this Privacy policy will be published on WED’s website and / or otherwise communicated to the Data Subjects.

10. Right to contact the appropriate authority

Data Subjects have the right to contact the competent supervisory authority to report a complaint or if they feel that WED has not addressed their concern in a satisfactory manner.
